Refund policy

At Burgertoys, we want you to be fully satisfied with your purchase. This policy explains your rights when cancelling or returning an order, including any statutory rights that may apply under applicable consumer laws.
1. Your Right of Withdrawal
1.1. If you are a consumer in a jurisdiction where a statutory right of withdrawal applies, you may have the right to withdraw from your purchase within the legally applicable withdrawal period without giving a reason.
1.2. Where a 14 day statutory withdrawal period applies, the withdrawal period generally expires 14 days from the day on which you, or a third party indicated by you other than the carrier, take physical possession of the goods. For orders containing multiple items delivered separately, the applicable period may run from receipt of the last item.
1.3. To exercise an applicable right of withdrawal, you must inform us of your decision by a clear statement. You may contact us by email at teamburger@burgertoys.in. To meet the applicable deadline, it is sufficient to send your communication before the relevant withdrawal period expires.
2. Effects of Withdrawal
2.1. Where you validly exercise a statutory right of withdrawal, we will reimburse the payments we are required to reimburse under applicable law, including applicable original delivery costs, within the legally required timeframe.
2.2. Where applicable law requires reimbursement of delivery costs, we will reimburse the cost of the least expensive standard delivery option we offer. Any additional amount resulting from your choice of a more expensive delivery method may not be refundable where permitted by law.
2.3. Refunds will generally be issued using the same payment method used for the original transaction, unless otherwise agreed or required by applicable law.
2.4. Where permitted by applicable law, we may withhold reimbursement until we have received the returned goods or until you provide evidence that the goods have been sent back, whichever occurs earlier.
3. Returning the Goods
3.1. Where you exercise a statutory withdrawal right, you must send the goods back without undue delay and within the applicable legal return period.
3.2. To start a return, contact us at teamburger@burgertoys.in with your order number. We will provide the applicable return address and return instructions.
3.3. You may be responsible for the direct cost of returning the goods where permitted by applicable law. If the return is due to a defective, damaged, incorrect, or incorrectly supplied item caused by Burgertoys, we will arrange an appropriate resolution and may cover reasonable return shipping costs.
3.4. You are responsible only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning, where applicable law permits such liability.
4. Refunds
4.1. Once we receive and inspect your returned item, we will confirm receipt and inform you whether your refund has been approved.
4.2. Approved refunds will be issued to the original payment method unless otherwise agreed or required by applicable law.
4.3. The time for a refund to appear in your account may vary depending on your bank, card issuer, payment provider, or other financial institution.
4.4. If an approved refund has not appeared within the expected timeframe, please first check with your bank or payment provider. If the issue continues, contact us at teamburger@burgertoys.in.
5. Faulty, Damaged, or Incorrect Items
5.1. This policy does not affect any statutory rights you may have regarding goods that are faulty, damaged, defective, or not as described.
5.2. If you receive a faulty, damaged, defective, or incorrect item, contact us at teamburger@burgertoys.in as soon as reasonably possible.
5.3. Please provide your order number along with clear photographs or other information showing the issue.
5.4. Depending on the circumstances and applicable law, we may arrange a replacement, repair, refund, or another appropriate resolution.
5.5. Where the issue is caused by an error on our part, we will provide an appropriate resolution without charging you unreasonable return costs.
6. Exceptions to the Right of Withdrawal
6.1. Where applicable law provides exceptions to a statutory right of withdrawal, such exceptions may include:
- Gift cards and digital vouchers.
- Downloadable or digital content supplied on a non tangible medium where the applicable legal requirements for the withdrawal exception have been satisfied.
- Goods made to your specifications or clearly personalised.
6.2. Any applicable statutory exceptions will be applied in accordance with the laws governing your purchase.
6.3. Sale and clearance items remain subject to any applicable statutory consumer rights unless otherwise permitted by law.
7. Returns for Customers Outside Applicable Statutory Withdrawal Regions
7.1. If you are located in a jurisdiction where no statutory right of withdrawal applies, Burgertoys may offer a commercial return policy subject to the conditions below.
7.2. You may request a return within 14 days of delivery, unless a different period is stated on the relevant product page or required by applicable law.
7.3. To start a return, contact teamburger@burgertoys.in with your order number before sending the product back. We will provide the applicable return address and instructions.
7.4. Unless the return relates to a faulty, damaged, defective, or incorrect item, products should be returned unused, in their original condition, and with their original packaging where reasonably possible.
7.5. Approved refunds for voluntary returns generally cover the product price only. Original shipping charges are generally non refundable unless otherwise required by applicable law.
7.6. Customers may be responsible for return shipping costs for voluntary returns, except where the return is due to a defect, damage, incorrect item, or an error on our part.
7.7. We may withhold a refund until the returned goods have been received and inspected, where permitted by applicable law.

9. Order Cancellation
9.1. Orders may be cancelled within 24 hours of being placed by contacting us at teamburger@burgertoys.in with your order number.
9.2. After the 24 hour cancellation window, orders may already have been processed or prepared for shipment, and cancellation can no longer be guaranteed.
9.3. Tracking information may take some time to appear or update after an order has been processed or shipped. The absence of visible tracking information does not necessarily mean that an order has not been processed.
9.4. If your order can no longer be cancelled and you have a statutory right of withdrawal under applicable law, you may exercise that right within the applicable legal period after receiving your order.
10. Customs and Import Charges
10.1. Depending on your country's regulations, international orders may be subject to import duties, taxes, customs charges, or other fees when they arrive in the destination country.
10.2. Where applicable, such charges are generally the customer's responsibility unless otherwise stated by Burgertoys or required by applicable law.
10.3. Customs procedures and charges are controlled by the relevant authorities and may vary between countries.

11.1. Burgertoys may update this Refund Policy from time to time to reflect changes to our services, business practices, or applicable legal requirements.
11.2. Any changes will take effect when the updated policy is posted on our website, unless a different effective date is stated.
